Accommodating Employees in a Time of COVID
Speaker: Sarah Wimberly, FordHarrison Navigating the many and diverse requests for COVID-related accommodations can seem as baffling as the disease itself. Must employees requesting accommodations on the basis of underlying health conditions and advanced age be accommodated due to their risk factors? And must pregnant employees also be accommodated given the uncertainty surrounding their risk level? Must routine accommodations, such as those based on religion or other disability, still be granted? Join Sarah Wimberly for this content rich and interactive session to master these issues.

Employee Separations during COVID-19
Speaker: Nancy Holt, FordHarrison
COVID-19 continues to create unique challenges for airlines, including forcing them to re-evaluate all aspects of their business model and implement cost and headcount reductions in order to weather the pandemic. This inevitably necessitates developing creative and legally compliant reductions in force.  In this session we will discuss both voluntary and involuntary employee separations, the many laws that are implicated, the importance of adverse impact analyses of non-union employee reductions, and how the CARES Act and federal and state WARN Acts impact the timing of employee separations.

FAA AFS-280 Air Carrier Training Systems will provide an update on continuing Training Exemptions as well as the status of the Fatigue Risk Management rulemaking project. Additional discussion topics include COVID-19 related disruptive passenger handling and the latest response from the CDC.

Legalization Marijuana & Drug Testing
Speaker: Jacki Thompson, FordHarrison
Medical marijuana is broadly or partially legalized in more than half of the states in the U.S. and many states have now legalized recreational use. However, marijuana use remains illegal under federal law. Variation in laws can create confusion over drug testing, drug-free workplace policies, discrimination, and how medical marijuana intersects with the Americans with Disabilities Act (ADA). Join Jacki Thompson of FordHarrison to discuss the ever-changing landscape of medical marijuana, including the interaction between state laws and accommodations under the ADA and potential conflicts with federal laws.

Advanced Specimen Drug Testing for the Aviation Industry & Regulatory Update

The presentation includes both the use of oral fluid for recent usage as well as hair testing for return to duty.  Both of these methods will be compared to the standard FAA urine test.

Christopher Morris, FAA Pilot Records Database Program Manager will provide an update on the PRD rulemaking and explain the difference between PRD and PRIA. The presentation includes a demonstration of how to look at pilot records.
